1. Who we are and what these terms cover
These terms are the agreement between you and Про Уебсайт ЕООД (Pro Website EOOD), a single-member limited liability company registered in the Republic of Bulgaria, which operates Burgas Fan. Full registration details are in the last clause.
They cover this website, the free early-access list and the Burgas Fan Pass. Paid sales are not open yet, so the clauses about paid passes take effect for you only once a pass can actually be bought. The version that applies to an order is the one published at the moment that order is confirmed, as the clause on changes below sets out.
Burgas Fan is an independent city guide and visitor pass. It is not affiliated with the EBU, BNT or the Eurovision Song Contest, it is not endorsed by them, and it does not sell official event tickets.
2. What the pass is, and what it is not
The Burgas Fan Pass is a digital pass delivered to your phone. It contains the Burgas city guide, day plans for your stay, updates during your visit week and, once they are published, benefits agreed with local businesses.
It is not an event ticket and gives no entry, priority or access to any official event. It is not accommodation, a flight, a transfer or a booking of any kind. Nothing on this site reserves a room, a seat or a place for you.
3. Early access
Joining the early-access list is free. It does not commit you to buy, it does not reserve a pass or a pass number, and it does not guarantee that a paid product will launch.
Marketing consent is a separate, optional choice that you can withdraw at any time through any marketing email we send. Nothing is charged at this stage, so there is nothing to refund if a paid product never opens.
4. How a purchase becomes a contract
Payments are processed by Stripe, our payment provider. We never see or store your card details.
A contract between us is concluded when the payment is confirmed and we send the confirmation email containing your pass. Until then nothing is reserved: an unfinished checkout holds neither a pass nor a number, and if a payment fails or is abandoned, no contract exists and you owe nothing.
Keep the confirmation email. It is the durable record of what you bought, at what price and on which version of these terms.
5. Price, currency and tax
A Founder Pass costs EUR 29. The price shown at checkout is the final price you pay.
The seller is not registered under the Bulgarian Value Added Tax Act. No VAT is added to that price today and none is shown on your receipt. Tax rules for digital services sold across borders can change what a seller has to charge. If they ever do, we will show the change at checkout before you buy: whatever price you are shown there is the whole of what you pay for that order.
If your card is not in euro, your bank or card issuer may apply its own exchange rate and fees. Those are set by them, we do not receive them and we cannot change them.
The founder price applies to the founder release of 300 passes. When that release is fully issued, the next release opens at EUR 49. A later price never changes what you already paid.
6. Delivery and access
Delivery is electronic. Your pass is sent to the email address you used at checkout as soon as the payment is confirmed, and nothing physical is shipped to you.
If the email does not arrive, check the spam folder first and then write to us: we will resend it. A delivery problem on our side is ours to fix, not a reason for you to lose what you paid for.
7. Your right to change your mind
Consumers in the European Union and the European Economic Area normally have fourteen days to withdraw from a contract made at a distance. The law makes an exception for services related to leisure activities that are supplied on a specific date or within a specific period, and a visitor pass built around one specific week is such a service.
Rather than argue about that exception, this contract gives you something better and simpler. A paid pass can be refunded in full up to 30 days before the event week begins, which means requests received by 11 April 2027. For almost every buyer that is a far longer window than the statutory fourteen days, and you never have to give us a reason.
That is a right you hold under this contract, so we are bound by it, and it runs up to and including 11 April 2027. Your rights if something is actually wrong with the pass are a separate matter and are never limited by this clause. After that date we do rely on the exception, and a pass is not refundable under this promise, because the city content, plans and partner arrangements it covers are prepared for that week in advance.
If it turns out that you do hold a statutory right of withdrawal despite the exception, you keep it in full. Nothing written here takes away a mandatory right you have under the law of the country where you live.
8. Refunds
A paid pass can be refunded in full up to 30 days before the event week begins, which means requests received by 11 April 2027. A refund returns the full amount you paid.
To request one, write to us from the email address you used at checkout, at any time up to 11 April 2027. We refund to the payment method you used, and we send the money back within fourteen days of the day your request reaches us. If your bank applies a different exchange rate on the way back than it did on the way out, that difference is theirs and not ours.
A refund ends your access to the pass.
9. Founder Pass numbers
Founder Pass numbers run from #001 to #300, in the order passes are paid for. A number is allocated only after the payment is confirmed, never held for an unfinished checkout.
Numbers are permanent and are never issued twice. If a numbered pass is refunded, its number is retired rather than sold again, so the founder release still ends once #300 has been issued.
10. If something is wrong with the pass
You have a legal guarantee that the pass works as described. If it does not, tell us and we will put it right.
If we cannot fix it within a reasonable time, you can ask for a reduction of the price or end the contract and get your money back, under the Bulgarian consumer legislation on digital content and digital services. This right sits alongside our refund promise above; it does not replace it and it is not limited by it.
11. Partner benefits
Benefits are provided by independent local businesses, not by us. We name a benefit only once that business has signed an agreement, and each benefit is published with its validity, availability and redemption conditions.
The full Founder benefit list will be announced by 31 January 2027. Partners and offers shown on the site before sales open are illustrative preview content and are not promises.
A business can close or stop taking part. If that happens we will replace the benefit or remove it, and we will say so. We do not guarantee that any individual benefit lasts for the whole period, and the loss of one benefit is not by itself a failure of the pass.
12. If the event week changes
We do not organise the event, we do not control its dates and we are not told about them before anyone else. If the week moves, the pass content moves with it and the refund deadline is recalculated under the same rule.
That recalculation can only ever give you more time, never less. If the week moved earlier and the rule would shorten a window you already had, your original deadline stands.
If circumstances outside our reasonable control stop us from supplying the pass at all, we will tell you and return everything you paid. That is the limit of what we owe you in that situation.
13. Using your pass
Your pass is for you and for the people in the group you bought it for. Do not resell it, publish your code or share it beyond that group.
A code that is being used fraudulently can be disabled. If we disable a pass, we write to the address it was bought with and tell the holder why.
You can contest that decision by replying to us. We will look at it again and answer you within two working days, because someone locked out of a pass they paid for cannot wait on our convenience. A pass disabled for fraud is not refunded. If we disabled one by mistake we restore it, and if we cannot restore it we refund it in full.
14. City content and how current it is
Opening hours, events, prices and transport information in a city change, sometimes at short notice. We keep the guide as current as we can and we update it during the visit week.
Even so, the guide is information and not a guarantee of admission, availability or opening. Confirm time-sensitive details with the venue or the provider before you rely on them.
15. Our content and what you may do with it
The text, plans, illustrations and other material in the guide and on this site belong to us or to the people who licensed them to us. Your pass gives you a personal right to use them for your own trip.
It does not give you the right to republish them, to copy them at scale, to scrape the site or to resell any part of them.
16. Our responsibility to you
If we do not keep this contract, we owe you compensation for the damage that follows directly from that failure, on the basis Bulgarian law sets. We are not responsible for damage that does not follow directly from it, except where we acted in bad faith, in which case the law makes us answer for all of it.
We are not responsible for the acts of independent businesses you deal with directly, such as venues, carriers or places you stay, beyond what we promised about the pass itself.
Nothing in these terms excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by our negligence and liability for fraud or fraudulent misrepresentation on our part. Nothing in them affects your rights as a consumer either.
17. Your personal data
The seller named in the last clause is the controller of your personal data. What we collect, why, how long we keep it and how you can exercise your rights are set out in the privacy notice.
Consent for analytics, marketing and support is asked separately, each choice starts as refused, and refusing any of them does not affect your pass or your rights under these terms.
18. Complaints and how a dispute gets resolved
Write to [email protected] first. We aim to answer a complaint within five working days and to resolve it without anyone needing to escalate anything.
We have not signed up in advance to any particular body for the out-of-court settlement of consumer disputes, and no law obliges us to. That is about us. It takes nothing away from you.
If we cannot resolve your complaint between us, you can take it to the Bulgarian Commission for Consumer Protection, or to the sectoral conciliation commissions for the out-of-court settlement of consumer disputes. If you live in another country in the European Union or the European Economic Area, the European Consumer Centre in your country will help you with a cross-border complaint against us. You can also go to court, at any time, whether or not you have tried any of this first.
19. Changes to these terms
We can change these terms for future purchases, for example when the offer or the law changes.
The version that applies to your order is the one published at the moment your order was confirmed, and it is the version identified at the top of this page on that day. A later change never reduces a right you already hold on a completed order.
20. Governing law and where you can go to court
These terms and any contract under them are governed by Bulgarian law. For any dispute that is not a dispute with a consumer, the competent court is Районен съд Варна (Rayonen sad Varna), or whichever court in Varna has jurisdiction over the value of the claim.
If you are a consumer, that court clause does not apply to you, because the law does not allow us to take away the court you are entitled to. If you live in the European Union or the European Economic Area, you can bring proceedings against us in the courts of the country where you live, and if we ever had to bring proceedings against you, we could only do so there.
For the same reason, if you live in the European Union or the European Economic Area, choosing Bulgarian law does not take away the protection given to you by rules of your own country that cannot be set aside by agreement.
21. The languages these terms are published in
These terms are published in every language this site is published in, and in Bulgarian. The version that binds both of us is the one in the language in which we addressed you and in which you completed your purchase, and that is the version to read.
Should two language versions ever differ, we do not use that against you: the reading more favourable to you as a consumer is the one that applies. We do not ask anyone to accept a translation as decoration for an agreement written in a language they were never addressed in.
22. How to withdraw, if the right applies to you
The clause on changing your mind explains why a pass built around one specific week falls outside the statutory fourteen-day right of withdrawal. We would rather not stake your rights on that reading alone, so this clause gives you the statutory instructions in full. They apply if, and to the extent that, the exception does not.
Where that right applies, you have fourteen days from the day the contract is concluded to withdraw without giving any reason. A pass is a service, not a delivered object, so the period runs from that day and not from any later date of receipt. To do it, tell us clearly: an email to [email protected] is enough, and so is the form below. Sending it before the fourteen days are up is enough to be in time.
If you withdraw, we return everything you paid within fourteen days of the day we are told, using the same payment method you used, and we never charge you a fee for that.
None of this shortens the broader refund promise made above. Where both apply, you may use whichever gives you more.
Complete and return this form only if you wish to withdraw from the contract.
